Terms of Service

Acceptance of Terms

By accessing or using GoRacquet ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

Description of Service

GoRacquet is a marketplace for social racket-sport sessions — badminton, pickleball, tennis, squash and padel — that allows users to:

• Discover social sessions near a search area they choose, filtered by sport, skill level, cost, date and distance
• Join sessions, hold a place on a waitlist, and cancel a place they no longer need
• Host sessions as an organiser, setting the venue, courts, capacity, cost, date and skill levels
• Manage attendance, waitlists and check-in for sessions they host
• Rate and review organisers after attending a session
• Receive notifications about new sessions, waitlist promotions and upcoming sessions

GoRacquet Is a Listing Platform, Not the Organiser

This is the most important term in this agreement.

• GoRacquet lists sessions created by independent organisers. We do not run, supervise, staff, coach or control any session
• Organisers are not our employees, agents, partners or representatives
• We do not own, operate, inspect or control any venue or court listed on the Service
• We do not verify the accuracy of any listing, the identity, qualifications, insurance, first-aid training or working-with-children status of any organiser or player, and we do not conduct background checks
• Any agreement to attend a session is between you and the organiser. We are not a party to it

You are responsible for using your own judgement about which sessions to attend and whom to meet.

Eligibility

• You must be at least 16 years old to create an account
• If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf
• You must have the legal capacity to enter into a binding agreement
• You must not use the Service if you have previously been removed from it

Physical Activity, Safety and Assumption of Risk

Racket sports are physical activities carried out in person with people you may not know. By using the Service you acknowledge and agree that:

• You participate entirely at your own risk. Sport carries risk of injury, including serious injury, and meeting people arranged online carries risk to personal safety
• You are responsible for your own fitness to play. Seek medical advice before participating if you have any doubt about your health
• You are responsible for your own equipment, insurance and safety. We provide none of these
• You are responsible for complying with the rules of the venue you attend
• To the maximum extent permitted by law, you release GoRacquet from any claim arising out of injury, loss or damage suffered at, travelling to, or arising from a session listed on the Service

If you feel unsafe at a session, leave, and report the session or user to us using the reporting tools in the app.

User Accounts

Account Creation

• You must provide accurate, complete and current information during registration
• You are responsible for safeguarding your account password
• You must notify us immediately of any unauthorised access to your account
• One person may not maintain more than one account

Account Security

• You are responsible for all activities under your account
• We reserve the right to suspend or terminate accounts that violate these Terms
• We may refuse service or close accounts at our discretion

Organiser Terms

If you list a session, you additionally agree that:

• Your listing must be accurate — venue, court numbers, time, capacity, cost, skill level and what is included
• You have the right to use the venue you list, including any booking, permission or licence required
• You are responsible for running the session, including safety, supervision, disputes and the conduct of attendees
• You are responsible for your own compliance with all laws applicable to you, including any insurance, permits, tax obligations, and working-with-children or child-safety requirements that apply where you operate
• You will honour confirmed places or cancel with as much notice as you reasonably can, and you will not cancel to circumvent these Terms
• You will not use the Service to collect money for anything other than the session you have listed
• You will handle attendee information responsibly, using contact details only to run the session and never for marketing or any unrelated purpose

We may remove any listing that we reasonably believe is inaccurate, unsafe, fraudulent or in breach of these Terms.

Player Terms

If you join a session, you agree that:

• You will turn up, or cancel your place in the app in time for it to be offered to someone else
• Repeated no-shows may result in restrictions on your account
• You will follow the organiser's reasonable directions and the venue's rules
• You will treat other players with respect

Costs and Payments

• GoRacquet does not process payments. No money changes hands through the Service
• Any cost shown on a listing is set by the organiser and is paid by you directly to the organiser or the venue, outside the app
• We are not responsible for collecting, refunding, disputing or guaranteeing any payment
• Refunds and cancellation charges are a matter between you and the organiser
• If we introduce paid features in future, they will be governed by additional terms presented to you at that time

User Content and Conduct

Content Ownership

• You retain ownership of all content you create and upload to GoRacquet, including session descriptions, photographs and reviews
• By posting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content as necessary to operate and promote the Service
• We do not claim ownership of your listings, photographs or other user-generated content

Acceptable Use

You agree not to use GoRacquet to:

• Violate any local, state, national or international law or regulation
• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, hateful, sexually explicit or invasive of privacy
• Harass, stalk, intimidate or endanger any other user, at a session or otherwise
• Impersonate any person or entity or misrepresent your affiliation, skill level or identity
• List sessions you do not intend to run, or list them at venues you have no right to use
• Collect or harvest other users' personal information, including contact details, for any purpose other than running a session
• Upload malicious code, viruses or any harmful computer code
• Attempt to gain unauthorised access to the Service, our systems or other users' accounts
• Scrape, crawl or use automated means to access the Service
• Use the Service for commercial purposes unrelated to listing genuine sessions, without our written consent

Zero Tolerance for Objectionable Content

We do not tolerate objectionable content or abusive users. You can report any listing, review or user from within the app. We review reports and may remove content, suspend or permanently ban accounts, and where appropriate report conduct to the authorities. We aim to act on reports of objectionable content within 24 hours.

Blocking Another User

Separately from reporting, you can block another user from the app at any time. Blocking takes effect immediately and does not wait on us:

• Neither of you can join a session the other hosts
• Any upcoming session you both hold a place in is cancelled for whichever of you is not the organiser, and that place is released to the waitlist
• Their sessions and reviews stop being shown to you
• The person blocked is not told, and cannot tell that you have blocked them

You can see and undo your blocks at Profile → Blocked accounts. Unblocking does not restore a place that was released. Blocking is not a substitute for reporting: if someone has behaved in a way other users need protecting from, please report them as well.

Ratings and Reviews

• Ratings and reviews must reflect a genuine experience at a session you actually attended
• Reviews are attributed to you, not anonymous, and are visible to other users
• You may not post fake, incentivised, retaliatory or misleading reviews, or reviews of your own sessions
• Reviews must not contain personal information about others, abuse, or content unrelated to the session
• We may remove reviews that breach these Terms, but we do not otherwise edit reviews to favour organisers

Attendee Lists and Visibility

• Sessions are public listings, but who is attending one is not. Other players see only the number of participants and a row of avatars showing a single first initial each. They are not shown your name, profile, skill level or contact details, and cannot look you up from that list
• The organiser of a session can see the full roster of players who have taken a place, because they run the session and record attendance
• Your profile, sports, skill levels and reviews are visible to other users when they view your profile or your reviews directly
• Your search area, notification preferences and email address are private
• Your phone number is private. It is released to the organiser of a session only once you hold a place in it, and only for as long as you hold that place — a waitlist entry does not release it, and cancelling withdraws it. Organisers may use it solely to contact you about that session

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use and protect your information. By using GoRacquet, you consent to the collection and use of information in accordance with our Privacy Policy.

Intellectual Property

Our Rights

• GoRacquet, its features and related technology are protected by intellectual property laws
• Our trademarks, logos and brand features are our exclusive property
• You may not use our intellectual property without written permission

User Rights

• We respect intellectual property rights and expect users to do the same
• Do not upload photographs or other content you do not have the right to use
• If you believe content on GoRacquet infringes your rights, please contact us and we will respond to valid notices in accordance with applicable law

Service Availability

Service Provision

• We strive to provide reliable, continuous access to GoRacquet
• We may temporarily suspend the Service for maintenance, updates or technical issues
• We do not guarantee 100% uptime or availability
• Notifications depend on third-party delivery services and your device settings, and may be delayed or fail. Do not rely on a notification as your only reminder of a session
• Some features may be limited or unavailable in certain regions

Service Modifications

• We may modify, suspend or discontinue any aspect of the Service at any time
• We will provide reasonable notice for significant changes when possible
• Continued use of the Service after modifications constitutes acceptance of changes

Limitation of Liability

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but may be limited, our liability is limited to resupplying the Service or paying the cost of having it resupplied.

Subject to the paragraph above, and to the maximum extent permitted by law:

• GoRacquet is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the Service will be error-free or uninterrupted, or that any listing is accurate, safe or will go ahead
• We are not liable for the acts or omissions of any organiser, player or venue
• We are not liable for any personal injury, property damage, data loss, business interruption, or indirect, incidental or consequential damages
• Our total liability to you for all claims is limited to AUD $100, or the amount you paid us for the Service in the past 12 months, whichever is greater

Indemnification

You agree to defend, indemnify and hold us harmless from any claims, damages, costs and expenses (including reasonable legal fees) arising from:

• Your use of GoRacquet
• Any session you host or attend
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit, post or transmit through the Service

Account Termination

By You

• You may delete your account at any time from Profile → Delete my account in the app. Deletion is immediate and permanent
• If you have uninstalled the app or cannot sign in, email privacy@goracquet.app from your registered address and we will delete the account for you within 30 days
• Upon deletion, your account and associated data are removed according to our Privacy Policy
• Any upcoming session you host is cancelled as part of the deletion, and every player holding a place or on the waitlist is notified. Sessions you hosted in the past are deleted along with your account
• If you would rather your sessions went ahead, cancel or hand them over yourself, and give your players notice, before deleting your account

By Us

We may terminate or suspend your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent, unsafe or illegal activity
• Endanger, harass or abuse other users
• Pose a security risk to the Service or other users
• Remain inactive for an extended period

Dispute Resolution

Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. You and GoRacquet submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

Dispute Resolution Process

• Before filing any legal claim, you agree to first contact us at support@goracquet.app and attempt in good faith to resolve the dispute
• If we cannot resolve it within 30 days, either party may pursue the matter through the courts
• Nothing in this section prevents you from making a complaint to a consumer protection or privacy regulator
• Disputes between users — including disputes about payment, conduct or cancellation at a session — are between those users. We may, but are not obliged to, assist

Apple App Store Additional Terms

If you obtained GoRacquet from the Apple App Store, the following also applies:

• These Terms are between you and GoRacquet only, not Apple. Apple is not responsible for the Service or its content
• Apple has no obligation to provide maintenance or support for the app
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, constitute the complete agreement between you and GoRacquet.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.

No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment

We may assign our rights under these Terms to any successor or affiliate. You may not assign your rights without our written consent.

Updates to Terms

We may update these Terms from time to time. We will provide notice of material changes by:

• Posting updated Terms at our published terms address
• Sending notification through the Service
• Email notification for significant changes

Your continued use of GoRacquet after changes take effect constitutes acceptance of the updated Terms.

By using GoRacquet, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
